As a parent, the need to provide for, and protect your child is a strong one. You want them to feel safe and secure, but during a time of turmoil a break up between parents can create, that is difficult to do.

The attorneys at the Law Office of Robert W. Kovacs, Jr. understand this is a trying, and chaotic time when the custody of your child is at stake. That's where we step in, because we will provide you the protection you need for you and your child, of your rights, and the rights of your child.

Our family law attorneys all have this belief in common; it is important to maintain a sense of family unity, despite the break up between two parents. An end to your relationship with the other parent does not mean an end to having a mom or dad, but it may seem that way to your child.

The Kovacs Law Firm believes a child custody case creates a need for the reorganization of the family structure, and not a dissolution. Our Massachusetts Family Law attorneys have strong family values, and are here to protect your rights as a parent, and to insure you child's rights are protected also. Your child's best interests are top priority in a custody case. You will be given a solid foundation from which you can begin to rebuild a new life for you and your child.

Any legal process is filled with complexities, and a child custody case is no different. We want to provide you with as much knowledge as you think you need, because knowing will eliminate the fear and uncertainties you are probably experiencing right now. Change does not always come easily, but having a better understanding of the child custody process, this transition will become a little less traumatic, and a more gentle one for your child. Reorganizing the family structure doesn't have to be a negative event. It can also be a time for learning and new growth.

The Different Types of Custody in Massachusetts

There are several options for child custody, but there are 4 main types that are recognized by the Probate and Family Court in Massachusetts. They are sole legal custody, shared legal custody, sole physical custody, and shared physical custody.

  • Sole Legal Custody - means one parent makes all of the decisions for the child such as education, medical issues, religion, and all other decisions critical to the child's well being.
  • Shared Legal Custody- Both parents share legal custody, and both make the decisions. The child usually stays with one parent part of the year, and the other for the rest of the year.
  • Sole Physical Custody - means the child lives with one parent while the other parent gets reasonable visitation, but no say in major decisions concerning the child.
  • Shared Physical Custody - is the favored agreement because it allows both parents to have an equal say in raising the child. Both parents are willing and able to share in the responsibilities, and they can have an amicable relationship with each other. Both parents usually have similar lifestyles and no drug or alcohol abuse or domestic violence.
