Common Question – Who will have custody of the children while my divorce is pending?
Massachusetts General Law 208 § 19 allows the Court to order custody of a child during a pending case on motion of either party. This is done by either party filing a Motion for Temporary Orders, very often at the same time as or just after the filing of the petition for divorce.
Every case is different; custody could be joint, sole, or one party with primary custody and the other with visitation.
