Can my spouse quit his job to pay less child support?

No! Massachusetts law allows a judge to "attribute" income to a party in calculating child support. This is often done in the case when one spouse is voluntarily unemployed or underemployed. However, if the alleged unemployed or underemployed spouse is the primary caregiver for a child less than 6 years old, then no attribution of income will be allowed.
