Can my spouse quit his job to pay less child support?

Can my spouse quit his job to pay less child support?

No! Massachusetts law allows a judge to "attribute" income to a party in calculating child support. This is often done in the case when one spouse is voluntarily unemployed or under employed. However, if the alleged unemployed or under employed spouse is the primary care giver for a child less than 6 years old, then no attribution of income will be allowed.
