Underinsured Motor Vehicle Claims in Massachusetts
As experienced attorneys one of the most troubling thing I ever have to tell my clients who have sustained severe injuries is that there is not enough insurance coverage to compensation them for all the damages. This is not uncommon in car accident claim. In Massachusetts all drivers are required to carry an insurance plan with $20,000 minimum coverage.
However, if you get into an accident and the other driver does not carry the appropriate insurance, then you will not be able to get reimbursed for the damages from their insurance company. Minimum insurance coverage does not go very far when there are severe injuries involved. If both drivers carry minimal coverage, but your claim is worth $100,000, you will still only be able to recover $20,000 from the other driver's policy.
So How Do Underinsured Claims Work?
There is under-insurance coverage that you can buy in extension with your insurance policy that be used if you are ever seriously injured in a car accident. In cases where you get into a crash and the other driver does not have insurance or has insufficient car insurance to cover all of the damages, you can then file a claim against your own insurance so that the under-insurance coverage kicks in to pay the difference.
For example, if your claim is worth $100,000 and the other driver carries minimum insurance coverage of $20,000, you may be able to recover the other $80,000 from your own under-insurance policy.
