Alimony Factors in Massachusetts

Alimony

Clients often ask "am I going to have to pay alimony?" or "do you think I could receive alimony?" Alimony is a type of payment or series of payments made to one spouse after the divorce. At the Law Office of Robert W. Kovacs, Jr., we will fight for you and our clients know that we are passionate about getting the best results whether you are looking for alimony or whether you fear paying it.

Massachusetts law includes a list of factors for the judge to consider when deciding whether to award alimony -- and if so, how much and for how long. These factors include:

1. the length of the marriage

2. the age and health of each spouse

3. each spouse's income

4. each spouse's employment and employability (including whether additional training is necessary for a spouse to become employed)

5. each spouse's economic and non-economic contributions to the marriage

6. the couple's lifestyle and standard of living when married, and

7. any economic opportunities either spouse lost as a result of the marriage.

The court may also consider any other factors it deems relevant as calculating alimony is ultimately at their discretion. This body of law is extensive and there are many considerations. Speak with Attorney Nick Carbone today and clear up any confusion regarding a divorce and whether alimony is something that we might explore in your case.
